Recent graduates Nicholas M. Gaunce (JD '07) and Robert Luther III (JD '06) have accepted an invitation to publish their co-authored law review article entitled Deliver Us From Evil: Why Bankruptcy Judges May Properly Rely on the Free Exercise Clause & RFRA to Protect Church Property from the Grasps of Tort-Creditors, in Volume 43 of the Valparaiso University Law Review (2008-09).
Mr. Gaunce, who recently completed a clerkship with the Superior Court of New Jersey (Law Division), has accepted a position in the Princeton, New Jersey office of the Philadelphia-based firm Post & Schell, P.C. This is Mr. Gaunce's second publication on the First Amendment. As a member of the ONU Law Review, he previously published his student Comment, entitled "Homeowners' Associations and Free Speech: Are They Subject to the Constitution and What Test Do We Apply?" which appeared in Volume 34 of the Ohio Northern University Law Review (2008).
Mr. Luther is currently employed by the Williamsburg, Virginia based firm Knicely & Associates, P.C. This is Mr. Luther's third co-authored law review publication on the First Amendment. His first publication Breaking Away from the "Prayer Police:" Why the First Amendment Permits Sectarian Legislative Prayer and Demands a "Practice-Focused" Analysis appeared as the lead article in Volume 48 of the Santa Clara Law Review (published Spring 2008). This past summer, he published a lead article entitled
A Superintendent's Guide to Free Speech in California Public Schools in the UC-Davis Journal of Juvenile Law and Policy (Summer 2008). He is currently working on a fourth article that involves a recent decision of the Supreme Court of Ohio.
